GENERAL TERMS AND CONDITIONS

These General Terms and Conditions govern the relationship between "Elixirika BioTech Ltd." (UIC BG205537369), with registered office in Sofia, Lozenets District, 47A Cherni Vrah Blvd., and the individuals using the website and online store located at https://elixirika.com/.

I. DEFINITIONS

  1. For clarity and brevity, the following terms are used with the meanings below:
    1. Merchant — https://elixirika.com/ and all associated subdomains.
    2. Product — any item offered online in the Merchant's e-store, described with its essential characteristics, image, and sale price.
    3. Order — the selected products and all attributes related to the method of delivery and payment chosen by the customer/user.
    4. Client/User — any person who has purchased or submitted a request to purchase a product from the Merchant's e-store.
    5. Online store — the virtual store at https://elixirika.com/ owned by the Merchant.
    6. Prices — the final price of each product clearly indicated, excluding delivery costs.

II. GENERAL PROVISIONS

  1. This document contains the General Terms under which the Merchant provides goods and services to its Clients/Users through the online store. These terms are binding on all Clients/Users. By clicking the "Confirm" button at the "Order Confirmation" step, the Client/User fully agrees with and undertakes to comply with these General Terms.

  2. The products on https://elixirika.com/ do not constitute a legally binding offer but serve as an online catalog describing the Merchant's product line.

  3. By clicking "Confirm Order," the Client/User agrees to purchase the items in the shopping cart. This action constitutes a binding legal agreement. The contract is considered concluded upon receipt of order confirmation by the Client.

  4. The Merchant has the right to offer promotional deals, discounts, bonuses, and gifts announced on the e-store's website.

  5. The official language of these Terms is Bulgarian. In case of discrepancy or conflict during access from an EU Member State or a third country, Bulgarian shall prevail. Cash on delivery payments will only be accepted in EUR.

III. ORDER PLACEMENT

  1. Each purchase order placed through the online store is subject to these Terms. In case of dispute regarding the will to be bound by them, the paying party shall be deemed the contracting party.

  2. Orders are placed via an electronic form available on https://elixirika.com/. The form must include: full name, delivery address, email, and phone number.

  3. When placing an order, the Client consents to these Terms by ticking the checkbox "I agree with the Terms and Conditions," thereby submitting an electronic statement under the Electronic Document and Electronic Signature Act. Consent is also deemed to have been given by submitting the order itself.

IV. DELIVERY

  1. Available items are delivered to the address provided by the Client within five (5) working days.

  2. Delivery is handled by a courier/shipping company and is at the Client's expense unless otherwise stated in promotional terms.

  3. Delivery is considered complete when the product reaches the building at the specified address.

  4. The Merchant shall package the goods appropriately. Elixirika is not responsible for melted or spoiled goods during the summer due to high temperatures.

  5. The Client bears the risk of damage/loss during delivery. Once handed to the courier, risk transfers to the Client. The Merchant is not liable for delays caused by the courier or other delivery providers.

  6. The Client or an authorized person must inspect the goods immediately upon delivery and report any damages to the Merchant. The Merchant is not liable for transport damages. If written delivery date and time have been specified by the Merchant, the statement is binding. If incorrect address, contact person, and/or phone number were provided, the Merchant is not bound by any obligation to fulfill the order.

  7. Upon delivery, the Client or a third party signs the delivery documents, if applicable. A third party is anyone accepting the goods at the address who is not the original buyer. If the Client refuses to accept the goods without justified reason, they must pay delivery and return costs. If the Client is unavailable at the specified address within the delivery period, the Merchant is released from its obligation to deliver.

  8. If the delivered product clearly does not match the order and the discrepancy is visible upon inspection, the Client may request replacement within 24 hours of receipt.

  9. Orders with incomplete, incorrect, or false address and/or phone number are considered invalid and the Merchant has no obligation to fulfill them.

  10. If the Client fails to pay by cash on delivery as agreed, the Merchant is not obligated to hand over the product.

V. HANDOVER OF GOODS

  1. Goods are handed to the Client or a third party, who confirms receipt by signing delivery documents.

  2. If the Client is unavailable or access is not granted at the specified time and address, and this leads to an inability to deliver through no fault of the Merchant, the Merchant is released from its delivery obligation. In this case, the sales contract is automatically terminated.

VI. PRICE AND PAYMENT METHOD

  1. All prices at https://elixirika.com/ are in Bulgarian leva (BGN) and/or the corresponding amount in Euros (EUR). Prices are per unit and do not include delivery costs.

  2. Shipping fees are payable by the Client based on courier rates listed on the courier's website and/or in these Terms.

  3. The Client must pay all customs duties and other export-related charges.

  4. Payment methods include: cash on delivery, bank card via virtual POS, or other methods available on the website.

VII. PRODUCT INSPECTION AND COMPLAINTS

  1. Complaints follow the Consumer Protection Act. Claims may be sent to the email address provided in the "Contacts" section of the Merchant's Website.

  2. Upon receipt, the Client must inspect the product immediately. Any visible defects, missing accessories, or required documentation must be reported immediately to the delivery person. A report must be drawn up in duplicate, signed by both the recipient and the courier representative, describing the visible defects in detail.

  3. If no complaint is made at the time of delivery or no report is signed as per Section VII, point 2, the Client loses the right to later claim that the product was delivered with visible defects, missing accessories, or missing documentation.

VIII. CLIENT RIGHTS AND OBLIGATIONS

  1. Clients may browse and order products at https://elixirika.com/

  2. Clients may check the status of their orders.

  3. Clients must pay the price as specified on the site https://elixirika.com/

  4. Clients must not:

    1. Copy, distribute, or use texts, images, or parts of the site without explicit permission from Elixirika.
    2. Use automated systems to download any information from https://elixirika.com/
    3. Overload the system with fake requests or other information (flood).
    4. Violate citizens' fundamental rights or Bulgarian laws and recognized international acts.
    5. Damage the reputation of other users.
    6. Upload, send, transmit, distribute, or use in any way, or make available to third parties, software, computer programs, files, applications, or other materials containing computer viruses, unauthorized remote control systems ("Trojans"), computer code, or materials designed to interrupt, impede, disrupt, or limit the normal functioning of the site.

IX. MERCHANT RIGHTS AND OBLIGATIONS

  1. The Merchant is not obligated to and does not have the objective ability to control how users use the provided services.

  2. The Merchant has the right, but not the obligation, to retain materials and information stored on the server https://elixirika.com/

  3. The Merchant may at any time, without notice, suspend, change, or terminate services if the User violates these Terms or at the Merchant's discretion. The Merchant is not liable for any damages resulting from such actions.

  4. The Merchant shall transfer ownership of ordered goods, deliver within the specified timeframe, and verify technical condition of each item before shipping (where possible without compromising packaging integrity).

  5. The Merchant is not liable for software/hardware damage or data loss related to using the site's services.

  6. The Merchant may collect and use information relating to its Users/Clients.

  7. Such information may be used by the Merchant unless the User explicitly objects via the email in the "Contacts" section of https://elixirika.com/. All purposes for which the Merchant uses the information comply with Bulgarian and applicable EU law, international acts, and good practices.

  8. The Merchant is not liable for non-performance due to unforeseeable circumstances, including accidental events, internet issues, and service provision beyond the Merchant's control.

X. PERSONAL DATA

  1. The Merchant guarantees the confidentiality of personal data. Data will not be shared with third parties unless required by law or with written consent. Falsified data voids this obligation. The Merchant may use personal data only for contractual purposes. All other uses comply with Bulgarian and EU law, international acts, internet ethics, and good practices.

  2. The Merchant shall not disclose personal data to third parties — state bodies, companies, individuals — except where the Client has given explicit written consent or the information is required by competent authorities under applicable law. Under Bulgarian law, invoices require a personal identification number and/or tax number and/or UIC/BULSTAT of the company acting as User.

XI. AMENDMENTS

  1. These Terms may be amended at any time. The Merchant will notify Users by publishing the updated version prominently on its website and providing sufficient time for review. If the User does not object within the given period, they are deemed to accept the changes.

XII. FINAL PROVISIONS

  1. Elixirika strives to keep site information accurate and up-to-date. For precise information, contact us at the email and phone in the "Contacts" section of the Merchant's Website.

  2. Color differences between product photos and actual goods are possible.

  3. Elixirika does not guarantee uninterrupted, timely, secure, or error-free access to the online store, as this is beyond the Merchant's capabilities, control, and will.

  4. Elixirika is a personal data controller and guarantees the inviolability of personal data provided by Clients. Disclosure is possible only when required by competent authorities under applicable law. By accepting these Terms, the Client gives indefinite, explicit, and unconditional consent for their personal data to be collected, stored, processed, and used by Elixirika for the purposes of fulfilling purchase and delivery contracts.

  5. These Terms are effective from the moment of publication. All disputes shall be resolved amicably; if not possible, all unresolved disputes, including those arising from or relating to interpretation, invalidity, performance, or termination, as well as disputes regarding gap-filling or adaptation to new circumstances, shall be resolved by the competent court at the Merchant's place of registration, in accordance with Bulgarian and, where applicable, EU law.
